Terms of Service — Hedotype

These Terms of Service ("Terms") govern your use of Hedotype, an experimental website operated under the Hedotype name (the "Service"). By creating an account or otherwise accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility (18+)
You must be at least 18 years old to use the Service. The Service deals with adult-oriented self-discovery content and is not appropriate for minors. At the present time, age verification is a self-attestation: you affirm, when you create an account, that you are 18 or older. Before public launch, we will replace self-attestation with a third-party age-verification flow.
If you discover that a minor has accessed the Service through your account or device, stop using the Service immediately and contact us at the address below.
2. Jurisdiction and governing law
The Service is operated from the United States. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and we agree that any dispute arising out of or related to these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you and we consent to the personal jurisdiction of those courts.
3. No medical advice or diagnosis
The Service is for self-reflection and self-discovery only. It does NOT provide medical advice, diagnose any condition, treat any condition, or cure any condition. Nothing on the Service is a substitute for professional medical, psychological, psychiatric, or other professional advice. If you have a health concern, please consult a qualified professional.
By using the Service, you acknowledge that any text, suggestion, or output you receive is informational and self-reflective in nature and is not a clinical recommendation.

4. AI-generated content
Parts of the Service generate text using artificial-intelligence systems operated by third-party providers. AI-generated text may be inaccurate, incomplete, or unsuited to your situation. We do not warrant the accuracy of any AI output. Treat AI output as suggestive, not authoritative.
5. Article 9 (special-category data) consent
Some Service features process information that the EU General Data
Protection Regulation classifies as "special-category data" under Article 9
(in particular, data concerning sexual behavior or orientation). We process
this data only with your explicit consent, captured separately from these
Terms. You can withdraw consent at any time at /account/privacy/withdraw-companion-consent.

6. Acceptable use
You agree NOT to:
- Use the Service to harass, threaten, or harm any other person.
- Attempt to access another user's account or data.
- Probe, scan, or test the vulnerability of the Service, except via an authorized security disclosure channel.
- Use the Service to generate or distribute content that is unlawful in your jurisdiction.
- Use automated tools to access the Service at a rate that materially burdens our infrastructure.
We may suspend or terminate your account if you violate these Terms.
7. Refunds
We operate on an honor-system refund policy during the Phase 0 testing window. If you are not satisfied with a paid feature within 30 days of purchase, contact us and we will issue a refund. We may decline obviously abusive refund requests (for example, the same address requesting refunds on multiple accounts in quick succession), but we will give you the benefit of the doubt.
8. Termination
You may delete your account at any time at /account/privacy. We may
suspend or terminate your account if you materially breach these Terms; we
will try, but are not required, to give you notice first. Sections that by
their nature should survive termination (intellectual property, disclaimers,
limitation of liability, indemnification, governing law) survive.
9. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) US$100.
10. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or damage (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Service.
11. Dispute resolution
Before filing a lawsuit, you agree to contact us first at the address below and give us 30 days to resolve the dispute informally. If we cannot resolve it, either of us may file a claim in the Delaware courts identified in Section 2.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be
announced on the Service and, where reasonable, by email. Continued use of
the Service after a material change indicates acceptance. The current version
of these Terms is always the version posted at /legal/terms.
